Registered Community Design

The original design of the Libreria del Vino is protected by Registered Community Design No. 002465302-0001 and 002465302-0002, owned by ELITE TO BE SRL, filed on May 16, 2014 with UMAI – Office for Harmonization in the Internal Market.

The Community Design (registered with the EUIPO) protects the aesthetic appearance of the product.

The law grants the exclusive right to use the design and prohibits third parties from producing, selling, importing, or displaying products that have the same appearance or an appearance that does not produce a different overall impression on the informed user.

Protection covers the entire product or part of it, and specifically protects:

  1. External visual characteristics
  • Lines and contours: The geometric shape and profile of the product
  • Shape and colors: The three-dimensional geometries and color combinations used
  • Surface texture: The texture of the material (e.g., a particular knurling or rough finish)
  • Materials: The visible use of specific materials
  1. Graphic and decorative elements
  • Ornamentation and decorations: Prints, repeating patterns, graphic motifs applied to the surface of the product
  • Web graphics and digital elements: It can also protect graphical user interfaces (GUI), icons, or web page layouts

Any attempt to clearly infringe the Community design pursuant to Regulation (EC) No. 6/2002, as well as an act of unfair competition, also causes serious commercial and economic damage. Any violation will therefore be countered by requesting the seizure of the goods, a judicial injunction, and compensation for all damages suffered and to be suffered, with additional costs borne by the offender.
